The Inquest Verdict: The deceased, M‘Cann came his death in consequence of wound deliberately inflicted under the left breast by a knife by Daniel Kenny.” Westmeath Journal, 6 May 1830. CITY CALENDAR. John Kh man end John Duncan, burglary and felony. Daniel Kenny, causing the death of John M'Cann. Saunders News-Letter, 1 July 1830. Daniel Kenny was indicted for the wilful murder of John McCann, in Farren's-court, in the parish of St. Mary, on the 25th of April, by giving him a mortal stab on the left side of the breast with a knife. Mary Hill being sworn, said-I recollect the 25th of April last; it was on Sunday ; I know Farren's-court- I lived in it at the time I knew John M'Cann, who is now dead ; I saw him at two o'clock that day; I saw Kennv at one o'clock the same day- (witness here identified the prisoner) -when M'Cann was removing the May-bush, Daniel Kenny stepped forward, and told him not to stir it, or that he would hurt him; McCann made no reply, but gave the prisoner a severe blow on the mouth ; the prisoner then went back, and said that he had John McCann in his power, and that he would summon him the next morning: -witness then took, hold of him, and he went quietly along with her to the door of the house in which they both lived, and remained there about five minutes; he then ran up stairs and returned in less than a minute with a knife in his hand ; I seized him, and asked was he going to commit murder? he replied, -by the Lord, I am, and if you .hold me I'll make you sorry ; he then ran forward, and gave a stab of the knife in the breast with his right hand; McCann took him by the neck and they were both upset; several persons then collected, and they rolled on the ground upwards of eight yards, and were tossed one over the other; McCann’s; friends took him up, and carried him to an hospital I did not see him again until he was waking; McCann's reason for removing the May-bush was for fear his boys should be sent to the tread-mill for creating a riot on Sunday.  Baron PENNFEATHER- Did Kenny seem very angry when he was struck in the mouth by McCann? Indeed he did. Did he stab M'Cann before he raised his head from the . May-bush ? he did ; he made a thrust at his breast as closely as his hand could go. . Did he inflict a wound on him by that thrust? He certainly did. Jane Mooney examined - I remember the day on which icCann was killed; it was the Sunday; I was sitting at tea, surrounded by, McCainn and his Children. He went out, and I followed, and saw. him corning down the court towards the May-bush: he said he should have it removed, and his aister who was along with him, said, I'll help vou, John;' they were both taking it away, and removing the large stones by which it was supported, when Kenny came down and said, let that bush alone; no! said the other, Out of this it must go; then Kenny went away, and came hack in a considerable time, having a knife in his hand; I asked him, is that a knife you have? are you going to commit murder? yes, by the holy, said he, and he stooped down, and stabbed McCann in the breast, and the blood rushed out of the wound, whereupon he fell back and Keinny fell over him; I then seized the prisoner by the right arm, and held him till McCann's sister came, and helped him up: he was then taken to an hospital, and Kenny ran away. , Cross-examined-I am ?? to the deceased ; the riot commenced in consequence of the May-bush; I Would give evidence as willingly if any of my neighbours were concerned . I do now when my daughter is left a Widow. George Cullen, a medical gentleman, deposed that John McCann died in consequence of a wound inflicted on his side, which penetrated the lungs. FOR THE DEFENCE. George .McDonnell swore that he knew the prisoner about four years, and was never aware that he was engaged in quarrel before this; he always considered a very industrious, quiet lad. John Carter, a chair-maker deposed, that the prisoner lived with him as an apprentice during the last five years ; he never knew him to be guilty of any impropriety before that for which he was then arraigned; he was always industrious and obedient, end conducted himself properly. The Jury found a verdict of Manslaughter ; and Baron Pennefeather sentenced the prisoner to be transported for Iife to Botany Bay. Freeman’s Journal, 7 July 1830.
