Irish Convict Database, by Peter Mayberry. John Kenny, age on arrival, 32, per Mangles (2) 1822, Tried 1821 at Kilkenny Co., Life. DOB, 1790, Native place, Carlow Co., Trade, Milkman ploughman. --------------------------------------------------- Kilkenny Assizes. COUNTY COURT.—SECOND DAY. Thomas Connors, James Connors, and John Kenny, stood indicted for arson, burglary, and assault, on the dwelling house of Richard Butler on the night of the 8th of January last. 'The first witness called was the Prosecutor, Butler—Recollects an attack on his house, in the night of the 8th January last; one of the party which attacked the house began to break down the slates; another man desired him to hand out his gun; they had commenced burning the house, when by the persuasion of his wife, the gun was given to the party; his wife handed it out; the party then compelled him to take his oath, that he would, on pain of death, and within four days, give up three acres of ground, which he then held; the party fired through the door; can't identify any persons as the assailants on the night in question. A short cross-examination of this witness, by Mr. Dixon, drew nothing of of importance for the defence. John Burn, sworn—Was at Richard Butler's house on the night it was set fire to, James Carty (convicted and executed at our last Spring Assizes), Thomas and James Connors, John Kenny, and others, were of the party which attacked the house; Carty was the leader; was engaged in his master's work, when Carty, on passing by, desired him to come on that night to his (Carty's) house to mend a pair of brogues; he went accordingly, and after staying about a quarter of an hour was about to leave the house, when Carty and his party came in; they asked him to accompany them to Ned Connor 's house; he refused, but on Carty's pulling a wattle from his bosom, and threatening him, he was afraid to persist in his refusal; they all went together to Connor's house, when they met three others, which, with four, being the number of the party that went there, made up seven; the men whom they met stood up on their arrival, and all left the house for Richard Butler's, in company; they had with them only two guns, one without a lock; in reply to a question from the Court, witness stated that the shots fired at Butler's were discharged (rem the gun with the lock, and that four shots were fired; the party had ammunition, but can't tell whether the gun was loaded with slugs or bullets. This witness deposed, without any important variance to the other circumstances of the attack, as proved by Richard Butler, the first witness....
