Offence: Theft > theft from a specified place Verdict: Guilty > with recommendation Punishment: Death THOMAS KITE was indicted for feloniously stealing, on the 21st of December, in the dwelling-house of Hugh Jones , two bank notes of the value of 2 l. each, and a bank note, value 1 l. his property . HUGH JONES . I am a linen-draper , I live at 84, Gracechurch-street . WILLIAM HUGHES . I am shopman to Mr. Jones. On the morning of the 21st of December, a young man with me counted the money in the till, and two hours afterwards he counted the money again; there was not money sufficient for what we had taken in the shop. Q. Is that young man here - A. No. I asked him to look if there was any one pound note with the mark on it; there was not. The notes we could not find in the time. The prisoner, Thomas Kite , was porter at our house. Q. Did you see the two pound notes and the one pound notes in the till before - A. I did. When Mr. Jones came home the prisoner was asked whether he had the notes; he said, no; he took some silver out of his pocket. Q. You do not know who took them out of the till, do you - A. No. Afterwards I saw Thomas Kite take them out of his pocket himself. Q. Where are they - - SHEPHERD. I am an officer. Here they are. They were taken out of his pocket before I came up to him. Hughes. We charged him with the notes; he denied having them. He then took out two two-pound notes, and said that was all that he had got; Mr. Jones took him up stairs and searched his box; he said you may as well give me the notes and go about your business, are all these the notes that you took: he said, no, there are more in the pocket; they are in this paper. These are the two two-pound notes, I put them in the till that morning, not an hour before they were missed. There is the lady's name on them. They are the two two-pound notes that I took of that lady, here is the one pound note that perhaps had been taken the same morning about three hours previous. For aught you know, the prisoner might have given change for them out of his pocket, and the other man is not here - A. No. COURT. Q. to Mr. Jones. Where did you get these notes - A. The prisoner gave them out of his pocket to me, when I missed these notes, I took him up stairs and insisted upon searching his box. I took out all his clothes, I found this pocket-book, it contained five pound odd in silver, I said I was certain he had the notes, he had better give them up; he put his hand in his pocket and gave them out before the other witness; they were loose in his coat pocket. Q. What else did you find upon him - A. Forty-seven pounds. He was my porter, he lived in the house and had twenty guineas a year; he lived with me between thirteen and fourteen months. Mr. Alley. Was the other man that is not here a shopman - A. Yes, he is not here; he is in my service now. COURT. What parish is your house in - A. St. Peter's Cornhill. Q. Have you any partners - A. None, at all. Q. Is the shop part of your dwelling-house - A. Yes, it is. Shephard. I know nothing of the robbery, the property was given to me, fifty-two pound in bank notes and five pound in cash. The prisoner left his defence to his counsel, called four witnesses, who gave him a good character. GUILTY - DEATH , aged 24. The prisoner was recommended to mercy by the jury, on account of his former good character. Thomas was sentenced to 'Life' which was usually meant 25 years of servitude. He may have only served 21 years but the original sentence was 'Life'.




I have done extensive research on this subject but have been unable to find any source or evidence to support the following statements in D. Wong's article:- 1. He built a house in Sydney in the 1830', 2. He built the Club House Hotel, 3. Kite's sister, Sarah, came to Australia in 1838, but that is probably true judging by an unexplained endorsement on a death or marriage certificate, 4. That Kite visited England in 1838, although there is evidence that he travelled to England in 1854, 5. That he built his sister a house near the [front] gate of Woolstone.However, a photograph of the Woolstone taken in the late 1800's shows a number of residences, but none near the gate. I suggest the following corrections:- A. The construction by William Cox was of a road over the Blue Mountains not the Central Tablelands, B. Kite received and purchased grants in the Bathurst, Orange, and Molong areas to the extent of about 49,000 acres freehold plus pre-emptive leases attached to various stations and some conditional purchase land, including Kangaroobie, Kite's Swamp, and Beri/Nubrigyn, all within the original nineteen counties (ie.within the Limits of Location). The lands beyond those limits including Molong Swamp, Bob's Creek, Burrawang, Wallamundry, Boramble, Wardry and others were all Crown Leases. Certainly Kite showed more interest in acquiring commercial property in Orange, Bathurst, and Sydney than he did in the Crown leases, although he did acquire the first parts of Mullingawarrina on the Bogan in the early 1860's. He gave Kangaroobie and Denham Park to his son Thomas, Kite's Swamp and Dockairne to son William, and Beri to daughter daughter Sarah Mary Cousins with the other properties shared amongst all the siblings. One interesting feature is that he gave or devised his property equally between the children irrespective of gender. There seems to be ongoing confusion about the identity of Kangaroobie contributed to by local historical societies; Bob's Creek was not part of it, it was to the west of Molong Creek, ie. outside the Limits of Location. Thomas worked under William Cox on the construction of the road over the Central Tablelands. He was one of ten men chosen by Governor Macquarie to settle at Bathurst in 1818. He was granted 50 acres, one convict servant, four bushels of seed wheat and one cow. He was also the owner of the site of the present (2009) Commonwealth Bank in Martin Place, Sydney City. He was the director of the Bathurst Bank in 1834. He gradually acquired land by grants, purchases and licence in the districts of Bathurst, Orange, Molong, Wellington, Lachlan, Parkes and Condoblin. Some of the properties (variations in spellings occur) where 'Molong Swamp' (also known as 'Cobong'), 'Burrawong' (central division), 'Wallamundry', 'Boramble', 'Wardy', and 'Kangaroobie'. In 1851 he held more than 200,000 acres and owned over 14,000 head of (mainly) cattle. From 1853, his acquisition of holdings diminished. He disposed of various stations. He sold some holdings but retained 'Molong Swamp' and 'Bob's Creek'. He also acquired property in Sydney in Pitt, Clarence, York, William and Hunter Streets and Orr's Wharf. He gave: 'Kangaroobie' to his son Thomas 'Wardy' to his son in law R.Y. Cousins. Thomas' wife's family spent a great deal of time living with him. They moved from Windsor to Bathurst, probably owing to the death of their mother. Thomas' sister, Sarah, came from England in 1838 to look after his young family while he visited England. She continued looking after then after the death of their mother. She married John Grey of Bathurst, and Thomas built her a home near the gate of his home 'Woolstone'.
