William LANE, together with George Morris & Bailey were convicted at an Auckland, New Zealand Court Marshall in May 1846 for desertion from the 99th Regiment of the British Army. Their defence was that they were taken by the natives in New Zealand and held in their custody. They received Life sentences and transported to Van Diemen's Land (Tasmania) per the ship 'Castor' in Nov 1846. He was first stationed at Norfolk Island and then transferred to Van Diemen's Land.
