Elijah was tried with breaking into dwelling & stealing but because constable Fairhead did not appear Judge directed the Jury to acquit prisoner as chain of evidence was incomplete they then tried him on another indictment of stealing clothing of John Kerridge this is what he was given 7 years for. When the Constable Fairhead appeared in court he was intoxicated, the Judge fined him 40s. discharged him from his office, ordered that his expences should not be paid.
