Report of the trial for his original offence. Commission Court, Yesterday. MURDER OF KELLY, IN CHURCH STREET. Luke Flood and John Logan, were then put to the bar, the former for the murder of John Kelly, and the latter as aiding and assisting therein. Edward Walsh sworn -Knew John Kelly,; he is not now alive; was with him the day be came to his death ; it was on Wednesday 19th October.; was going with him through Church-street, between seven, and eight o’clock; saw there. a show ,Kelly went up to the show along with a person named Shannon; the first performance was going on, and they stopped in the street until it would be over; Kelly went to the asort of the show and laid his hand, against the wall; Flood hid him go off; Flood was standing on the stage ; they had an argument ; the argument stopped .. about 10 minutes while the people were coming out; they (the witness and his companions) were going into the show, and met Luke Flood who collared witness by the coat, saying, here are the two boys ; he called out Billy; then he struck witness in the mouth ; he then struck John Kelly on the back of the head,; Luke Flood gave the blow ; it was with a round stick better than ...- feet long, knows no other of the party but Flood; saw the deceased after in about three quarters of of an hour;: he was then dead ; gave no provocation to Flood the argument between Flood and deceased lasted about three minutes.. , -By a Juror-The argument arose, he believes, because he put his hand to the wall. Flood was placed there, gentlemen, as a watchman, and was paid 7s. a week to ?? the place. Walsh,-We were not on the wall at all; thinks the quarrel was caused by prisoner believing they wanted to get into the show – the wall .was part of the place of the show; did not want to get in ... ?? - James Grogan: at the show the evening Kelly was beaten; Saw him beaten; on the night persons were coming out of the show; ,deceased was standing opposite, and Flood came up and gave deceased a blow down the back; did not see what happened before; Kelly made no ?? but went down towards the church, and Flood called Billy and then Logan and others followed deceased . awl-beat him ;-did not see Logan beat him but saw Flood do so; saw no stick with Logan; Flood had a weapon. Saw the deceased ... .... ... then briskly charged the jury, and stated that under the amended act this, was a case of manslaughter; but if the jury did not differ in opinion-with him it should be considered as a case of aggravated manslaughter; -: The jury without hesitation, returned a verdict of not guilty of the murder, but guilty of the manslaughter. The learned Judge then proceeded to pronounce the sentence of the court, which, was that the prisoners each be transported for life. Freeman’s Journal, 3 Nov 1831.
