Larceny.-Hannah Burke was brought up on remand charged with having feloniously received certain goods stolen from Webb's Hotel. The Police Magistrate said that the prisoner was charged with having received property " stolen as aforesaid" by her daughter, and the daughter was discharged as the evidence was insufficient. It then became a question, the charge being so worded, whether the prisoner could be convicted. He had grave doubts on the subject and he had found a similar case in the law books-a docision of Mr. Justice Puttorson -in which it was held that the prisoner could not be convicted. Under these circumstances the prisoner before the Court would be discharged, but he might add that it was competent for the police to indict her for having received the goods from a person or persons unknown. Before the Police Magistrate and Mr. Huybers, J.P. ANOTHER CHARGE.-The same prisoner was then oharged with having on or about the 1st May, 1873, stolen two books, the property of L. R. Castray and others. The prisoner pleaded not guilty, and was defended by Mr. Moriarty. L. R Castray deposed that he was hon. Secretary to the Tasmanian Club, when the Club was at Webb's Hotel, The two books produced belonged to the Club, and no one had a right to remove them. A number of books had been missed. He know the prisoner by sight, and had seen her about the Club promises, To Mr. Moriarty : Never know a man named Groom about the premises. Emma Webb, of Webb's Hotel, deposed that the prisoner had been in her employ. Was with Detective Simpson when the prisoner's premises were searched and saw the books produced found. The Tasmanian Club had a library at the hotel, from which books had been missed not more than a year ago. To Mr. Moriarty : The prisoner said that a man named Groom took the books to her house in a box with some other articles, but Groom had not been in witness' employ for three years. Detective Simpson deposed to the arrest of the prisoner, the searching of her promises, and the finding of the books, which she said she had purchased from a broker in Liverpool-street, whose name she did not know. This was the case for the prosecution. Mr. Moriarty then addressed the Court, and dwelt upon the prisoner's good character. The Police Magistrate said that this was only one of a series of thefts, and the prisoner would be sent to gaol for twelve months. The Mercury, 11 June 1873.
