ENNIS ASSIZES, AUGUST I. Michael Madigan, Michael O’Neal, Thomas Linnane, Daniel Kelly, John M’Namara, (Hugh) William Chambers, Patrick Degidan, John Kelly, Murtogh Kelly, Daniel Dixon, Luke Madigan, Michael Fox, and John Madigan, were severally indicted were severally indicted, for aiding and assisting one James Doyle in the wilful murder of Michael Cleary, at Labasheedy in February last. It appeared from the evidence, that on the day laid in the indictment, which was Sunday two parties, called the Macgraths and the Birminghams, to the amount of persons, had desperate conflict at Labasheedy, from six o’clock in the morning until about one, during which a man, named James Doyle, rested a firelock on mud wall, in the morning until about one, during which a man, named James Doyle, rested a firelock on mud wall, presented it and fired, and instantly the deceased, Michael Cleary, fell, and died in about one minute after being shot. Others were armed with sticks, stones, &c. The prisoners belonged to the Macgrath party, and had their party chalked. The jury retired for about quarter of hour, when they returned, acquitting Michael Fox and John Madigan, and finding all the rest guilty of manslaughter. Five were sentenced to transportation for seven years the other six, to one year’s imprisonment. Belfast Commercial Chronicle, 13 Aug 1827.

TICKET of LEAVE 1832: "no 33/690 , 7 October 1833" native of Clare, Labourer Trie at Clare 1 August 1827, 7 Years DoB: 1802 5ft 5&1/2 in; Fair Ruddy Complexion Brown hair, Hazel eyes. Allowed to remain in the District of Bathurst by the Bathurst bench.' OVERWRITTEN on the T/L: "Torn up on its receipt from Bathurst in letter dated 10 October 1834, states that Maddigan had been subpoenaed to attend the Supreme Court in xxx (Oct?) 1834 and not returned."


Michael MADDIGAN at age of 27 years was found guilty of manslaughter, at the Ennis Assizes at County Clare on 1st August 1827, and transported for 7 years on "Borodino" arriving NSW in June 1828. From Indent: *could read and write. Catholic. Married with one child. * no prior convictions. * Native of Co Clare, ploughman and shepherd. * 5ft 5" tall, Ruddy freckled complexion, Brown to grey hair and hazel eyes. * Disposed of from ship to William Lawson Junior at Bathurst. Matthew Conway was found guilty of the same crime at the same assizes on the same day and sailed on "Borodino" also with the same sentence. Was it the same offence?
