Convict Notes
Assizes Intelligence, North Riding Tipperary. Morgan Maher, Michael Maher, John Dwyer, and Edmund Hayden, were indicted for the wilful murder of Michael Kennedy. Margaret Kennedy examined—The deceased was husband; he is dead; near Burrisoleigh, and on the 27th November, 1837, were the fair together, left for home together, there were no persons in company with us; going out of the town met Michael Maher and seven or eight more; Maher came over to the deceased and caught him by the breast; the deceased asked what they wanted with him. for if was a fight, fighting did not answer him, one of the men outside the crowd stooped down to rise a stone, and I caught him by the collar of the coat; I asked him what he wanted; my husband was then allowed to to on little distance ; ... the party came then against me, coming from where my husband was killed, and shouting for Harrington he said It was very easy for them to shout when there was no person meet them; Pat Dwyer put a stone to my mouth and was going strike me, but a man named Monks who has been acquitted, said enough has been done (identified the prisoners, except Morgan Maher); Hayden was with the crowd but doing nothing. This witness was cross-examined bv Mr. Hatchell. Two other persons named Harrington and Shanahan were examined —The first witness stated that saw Michael Maher push out from the crowd and fling a stone at the deceased, which knocked him his knees ; got up, when he was again hit, witness knew the two Mahers to be there, but was not sure of Morgan. This witness was cross-examined, in order to shew that had provoked the fight shouting for any one against a Harrington. .... Doctor Purchin examined the body the deceased, ... was wounded upon different parts of the body and almost a mass of contusions from stones and kicks. ...
