Originally assigned to Mr Foster of 'Elswick' on Parramatta rd, property sold to Mr Norton. "Daniel Marley, assigned to Mr. Norton, was charged by his overseer Mr. Skyling with insolence. He accused the prisoner and another with attempting to scale the wall on Sunday night. The insolence ac cording to the evidence of Mr. Skyling consisted in the prisoner telling him when accused, that " as he was blamed for every thing he would take the blame of that; if a man was murdered on the farm, he would be blaimed for it." The prisoner denied the charge and said it was all spite on the part of his overseer, who wanted to prevent him from obtaining his ticket of-leave since he had been trying for it. Mr. Skyling said, at all events the prisoner did not come in on Sunday night until eight o'clock, which was an hour beyond his time. The prisoner replied, that he was about the farm with the other men, and that Mr Skyling let him in that night himself, (this Mr. Skyling admitted). He would wish the constable, who apprehended him to be examined. He was not safe in the place, and he had requested to be turned into government. Constable Sul livan was then called, and stated, that when he took the prisoner in charge from Mr. Skyling, he asked the nature of the offence, and Mr. Skyling replied, there was no charge; Mr. Norton wished him to be turned into government. Accordingly he took him to the watch-house but gave in no charge, and left him there for sufety. Mr. Skyling said, he had a greatlof business to attend to on the farm, and he did not wish to be bothered coming into court. The magistrate said, there was no proof of his having attempted to scale the wall, but he would find the prisoner guilty of insolance to his overseer, and sentence him to receive a corporal punishmentof twenty five lashes, and to be returned to government. Had 6 children to Leitch, youngest 3 stayed with Isabella when she moved to Victoria with Marley, where they had twins in 1843.
