CHARGE OF MURDER. Patrick Burke and Michael Maxwell were indicted for the wilful murder Patrick Shea, at Toomavara Mr. Scott. Q.C., stated the case for the prosecution, and characterised the homicide as arising from one of those factious proceedings which distracted the country. Mary Tierney examined—l remember the 22d of July last; on that day I saw the deceased at Toomavara; first saw him come out of a public-house, and come across the street until got opposite to the chapel; Mat. Ryan come up to him and took stick out of his hand; the deceased said it's peace I want here’s the peace will give you,” said Johnny hitting him with a large stick, and knocking him down on his knees ; a party then gathered about the deceased, and beat him down with sticks; I saw no more. Cross-examined by Mr. Hatchell, Q.C. —This was a fair day; I lived three miles from Toomavara, and had gone there to buy some wearables. I did not take a drop in the fair; I very seldom saw a fair at Toomavara without a fight; there was no shouting or noise before the man was killed; I held the hat of the deceased until he was brought into a house; I did not see a brogue maker named Ford there; a crowd gathered about the deceased, some striking and others not; but not one went to save the deceased. Michael Carroll examined—l was the fair of Toomavara on the 22 of July; was between five and six the evening when I saw the deceased struck down ; but I was not by the commencement of the transaction; I observed Mat., John, and Darby Ryan in the crowd; and the two latter men struck the deceased with sticks; I saw Stephen Ryan and the prisoner Maxwell, push the deceased out from Gleeson’s door, into which he was trying to make his escape ; they went between him and the ...
