1829 - Waterloo's first voyage arrived at Sydney Cove 9 July 1829. 180 Male Convicts. 2 Died on voyage. 7 sent to the hospital on landing. Total mustered; 171. Stephen Addison - Commander Michael Goodsire - Surgeon Superintendent [His wife was a passenger] 1842 - The Waterloo voyage of 1842 was wrecked on 28/8/1842. 189 people drowned, these being 143 convicts, 15 men of the 99th Regiment, together with 17 wives and children, the boatswain Mr. Chiverton, the sailmaker, the carpenter and 11 of the crew. Convicts were then received in Cape Town Prison from the wreck of the Waterloo, 2nd September 1842. They then completed their voyage to VDL per “Cape Packet” which arrived on 23/11/1842.

The convict indentures state that James McGivern was 19 years old. He could neither read nor write; Religion Roman Catholic; status single and a native of County Down. He was a mason's labourer. James was convicted of robbing till on 24 January 1836 and sentenced to 7 years. He had no prior convictions. Physical attributes: Height 5 feet 6 1/2 inches; complexion pale; hair brown and eyes grey. Transport number 10. Prisoner number 36-1815. NSW 1837 General Census states that James McGivern was assigned to i) Government Service in Sydney and ii) Mr John Thorn at Parramatta. Received ticket of leave on 3 April 1841 (number 41/906) at Goulburn, NSW. Received Certificate of Freedom on 25 September 1843 (43/1603).
