Edmond Molumphy was next indicted for assaulting Manuel Molumphy on the King’s high way at Fermoy on the 18th March, and stealing from  his person a Banker’s note, value ​?. Maurice Molumphy sworn-— brother to the prisoners; ; remembers being at Fermoy the 18th March last, when the prisoner came up to him and stole from his pocket a note ; witness screeched out that he was robbed, upon which the other struck him with a stick and then ran away . Cross-examined Mr. Howard—Would like to hang his brother, for well deserves it; this was about o'clock in the evening; only took a drop that day that did not signify—three pints porter, and his horse feed of oats ; witness would not go the length of his foot to see his brother hanging, but he would have no objection to get him hanged for all that; is not married, but has kept Miss for six years. Biddy  Lombard said she was desired by the last witness to try and help him to transport the prisoner ;  he told witness that it would be impossible for him to transport his brother, unless she would swear that he had robbed him, and promised her a new cloak if she would do so ; it was in consequence of a quarrel which arose between the two brothers that the  prosecutor wanted to send the other out of the country. His Lordship intimated to the Jury that they should find  the prisoner guilty of stealing, but not forcibly, from the prosecutor's person, which would do away with the capital offence. They accordingly found a verdict to that effect —Sentence postponed.  Southern Reporter, 4 April 1826.
