Arthur Murphy was indicted for entering the dwelling-house of Wm. Sullivan, with intent commit a felony. At about one o’clock in the morning, the prosecutor was awoke by a noise in his house, when he found the prisoner, who had entered, and had tied up several articles which he was about to carry off. Guilty. The Court observed that the prisoner, in some other instances which had been tried, had been very leniently indicted, for, if indicted for a burglary and convicted, as he might have been, he should have felt bound to order him for execution, from the prevalence of that offence in the City. To be transported for 7 years. Southern Reporter, 28 March 1826.
