Petition for mitigation of sentence to Gov. Macquarie. Thomas states he had a wife, 2 children and the wife is pregnant, has a recommendation from Captain Gill, was a stonemason by trade, and had recently “been the principal in the erection on Mr W. On return of fines and punishments in the Police Office. Thomas & William Wilkinson were charged with “stealing 2 casks”. Thomas’s punishment was “Ticket of Leave cancelled and 28 days on treadmill…and then both to a clearing party for 12 months.” (Source: SRNSW Col Sec Papers, Reel 6023; 4/6671 p.91) 1828 Census – Thomas CANNA (sic), aged 45, TL, Archduke Charles 1813, labourer, catholic, Kent St, Sydney (C0278) Catherine CANNA (sic), aged 42, FS, came per ship Brox. 1814, catholic, Kent St, Sydney John CANNA (sic), BC, aged 13, catholic, Kent St, Sydney Mary Ann CANNA (sic), BC, aged 10, catholic, Kent St, Sydney Ellen Connor, aged 14, BC, prot., servant, Prospect to Denis Begley (C2122) 1863, 29 May – “COURT MARTIAL OF CAPTAIN SAUNDERS…Cross-examined by Colonel Hamilton : I think when Captain Saunders went into the public-house at Binalong he had on a red coat, black uniform trousers, and a cap with No. 12 on. The red coat was something similar to that he now wears. I cannot remember whether it had gold facings. The name of the civilian who quarrelled with Captain Saunders at Binalong was Thomas Kenna. He is a stonemason by trade. I saw Captain Saunders go away from the public-house. I saw no one with him. I am almost positive that Captain Saunders was alone when I afterwards saw him go to his hotel. I am quite sure that he was not accompanied to his hotel by Sergeant Burt so long as he was in my sight. I have on other occasions applied to the Magistrates to have men released from custody who had been taken up for being drunk, if they were sorry for what they had done. I applied for Kenna's release because I knew him to be a hard working man, and would not have acted so if he had not been drunk. He also requested me to intercede for him. I requested Captain Saunders to speak to Mr. Beckham on behalf of Kenna. Captain Saunders appeared to me to be sober when he was in the public-house at Binalong. I have in my possession the letter from Captain Saunders that I alluded to.
