John Oswell was convicted at Chelsea Barracks in England on 23rd June 1804 for desertion. Given 7 . years' transportation sentence. But he did not sail until 1807 on the Duke of Portland and arrived in NSW when 3 years of his sentence was already done. Shortly after his arrival he managed ot get a capital advance from Gregory Blaxland even though he was still a convict. He must have been assigned to Gregory Blaxland, who recorded paying him 5/5 in Nov 1807 for wages: Colonial Sec Papers - "On statement of capital advanced by Gregory Blaxland in his concerns from 27 Dec 1806 to 24 Nov 1807" in NSW he married in 1811, on 24th June, to Irish convict Mary Saunders who had been sentenced in Dublin in December 1808 to 7 years for stealing a bank note. Mary was aged 24 in 1809, so was 26 years on marriage. In 1811, 24th June, Mary Saunders married John Oswell, at St John’s Parramatta. Mary could not sign, John Oswell could. Witnesses were Thomas and Mary McKenzie. NSWBDM 1245/1811 V18111245 3A Mary in 1814 was recorded as being the wife of Oswell and having one child. No baptism record found. On 22 July 1811, Oswell was witness at marriage of Michael Duggan and Elizabeth Johnson at Parramatta. He rejoined the army in March 1814, enlisting in the 73rd Regiment. It was soon to be shipped out to the sub-Continent. - Enlisted 12 Mar 1814 Rank: Private, Place: Sydney - Enlisted for an unlimited service; - Departed NSW per ship General Brown, 19 Dec 1814 for Ceylon; Duty in Ceylon: 1815; - Paid 1/14/0 pounds sterling allowance on voyage from NSW to Ceylon between 25 Dec 1814 and 2 Mar 1815 His Wife's name did not appear in NSW records again so she presumably went with him or followed him.
