The "Portland" had sailed from Cork in Ireland on the 21st February 1833 and it was her 2nd trip to Australia. The following is a Court Record researched and supplied by The Irish Genealogical Association. "Patrick Pendergast had been charged, tried and convicted of the rape of Norroy Nowlan and sentenced to death by hanging on the 24th inst. The circumstances of this case were particularly atrocius, the prosecutrix was a very decent country young woman. The outrage took place two years ago near Knocklofty, as she was on her journey she was met by four ruffians who forced her into a remote field, and abused by the four miscreants, a child was the consequence. It was only the other day that the prisoner was apprehended; he and his vile associates ever since eluded the vigilance of the Police. The prosecutrix since got married and is now in comfortable circumstances." Patrick was tried at the Summer Assizes and a brief statement regarding the trial appeared in the "Tipperary Free Press". It read as follows " ....Patrick Pendergast was sentenced to die on Saturday the 29th November for rape.' (3/11/1832). Waterford Mirror originally reported Patrick Pendergast's names as Thomas Pendergast but believed to be reporter error; all later issues record him as Patrick. Theres is no record of the reprieve of the death sentence. No record on the arrest of Patrick Pendergast was found. Following his arrival Patrick was assigned to Ronald Campbell in the Monaro district. • Occupation: Carrier and Farmer. • Religion: Catholic. • He lived at Delegate, Boyd Town, Kiah, Green Cape.
