City Crown Court, Monday. Michael Punch was indicted for having, the 18th December Iast. stolen six gallons wine, value 30s., the property of Mr. Thomas Curtis. Tim. Beamish, Clerk in the service of Mr. Curtis, swore that he had the charge of a wine store of Mr. Curtis. A certain day he filled a vessel with wine, which in the course of a week he found to be deficient ; he suspected prisoner, (who had been in prosecutor’s employment,) and charged him with having a private key for the cellar door. At first he denied but being pressed, asked witness to accompany him, when showed him a key buried, which proved be a skeleton one. Prisoner, when first questioned, denied having been in the cellar, but subsequently acknowledged he had been there. The wine was Benecarlo, but it sold Port ?—The witness was examined by the Learned Judge at great length. John Mckee saw prisoner in the store about eight clock evening in December; saw him when he came out had known him ; prisoner had candle , and offered witness drink of Wine, tho’ had no vessel to hold it, which witness refused—Guilty—To be transported for seven years.
