A fresh jury having been then empanelled, Charles Reeves (sic), who figured at the last assizes in a charge of apple stealing, was indicted for stealing a colt, the property of the same prosecutor, Mr Daniel O’Connor, of St Peter’s Pass. From the evidence it appeared that the prisoner, after his acquittal of the fruit charge, having determined upon a change of residence to Hobart Town, removed for that part of the colony, and at the same time there disappeared the colt in question, which was a tame and favourite animal, eighteen months old, valued by the prosecutor at £4. The colt was, within two days afterwards, found by District Constable Goodwin in the possession of Reeves, who was leading it, on the main road at Green Ponds, with a rope round its neck, and at the same time proffering it as his own property for sale, representing it as ‘one of his own breeding’. Both Mr O’Connor and his overseer, Bennett, distinctly identified the colt, and some other witnesses proved that on the night before the prisoner was encountered by Goodwin he was met leading a young horse, although it was too dark to recognise its colour. Constable Andrews, one of the number, fell in with the prisoner at Cross Marsh, still leading the colt, which he warned the witness not to approach, as it ‘was very shy’. It was the prisoner, however, who was shy (of a constable) for the animal appeared extremely docile on the policeman going up to him. In his defence, Reeves stated he had received the horse for a consideration from some man who had unhappily sailed for Port Phillip, and offered to produce a witness to prove that he had heard him (Reeves) say he had a horse. This evidence the Court declined to receive, and the jury, without a minute’s hesitation, found the prisoner Guilty.
