Elizabeth, who would have born circa 1799/80, was tried 16 Jul 1798 at Hertfordshire Summer Assizes, Hertford. Elizabeth was committed to trial on 21 Apr 1798 by Thomas Marsham, clerk, and was charged on the oath of Sarah Pryor, wife of William Pryor. The trial Indictment [NA ref:ASSI/94/1449] shows "Elizabeth Smith, late of parish of Ridge in County of Hertfordshire spinster on sixteenth day of April . . . at the parish aforesaid, one linen apron the value of one shilling, one pair of cotton stockings of value of sixpence, two muslin aprons of value of five shillings, two muslin handkerchiefs of the value of five shillings, one linen sheet of the value of five shillings, four pieces of lace of the value of one shilling, two pieces of ribbon of the value of three pence, one cap c...d of value of two pence one bit of linen of the value of one penny and one bit of cotton of the value of one penny of goods & chattels of William Pryor in the dwelling house of William Prior" The Crown & Gaol Book [NA ref:ASSI/31/18] shows: Entry No. 2 - Elizabeth Smith (19yrs ) charged with stealing goods of value of £2/14/3 of William Pryor in his dwelling house. It says, "Puts herself - jury say guilty of stealing to the value of 29 shillings only. No goods - to be transported beyond the seas for the term of seven years to such place, &c pursuant to the statute &c". Elizabeth married on 25 Jul 1825 at St Matthews CoE, Windsor NSW, to David HORTON, but it seems this was about 20 years after the couple had commenced living together as husband & wife. David was also a convict, who arrived in 1791 aboard the "William & Ann"; he arrived under the surname HALTON. Elizabeth and David had at least 11 children between the years 1804 & 1822. (David already had 3 children from his 1st marriage, and later a son with a 3rd wife.) David is listed in all the musters and census from 1801 to 1828; he was generally referred to as a landholder in the Windsor district but it seems his land was at Pitt Town. From 1806, the musters show Elizabeth (and children) living with David. Elizabeth died late December 1830 at age of 52 years and was buried 1 Jan 1831 at Pitt Town Old Cemetery. (The burial was recorded in St James', Pitt Town register.) David died in 1842 and his grave is located next to Elizabeth.
