Principal Superintendent of Convicts Office, 16th April 1838. The wives and families of the undermentioned prisoners having arrived free at the public expense. per ship Diamond, they will be delivered on application at this Office: Patrick Smith, Roslyn Castle (2) Sydney Monitor, 20 April 1838.




Cow Stealing. Patrick Maguire, Patrick Smith and Hugh Hanna, were indicted for stealing a cow from Michael Gallagher, on 4th December last, at Balleek. Michael Gallagher, examined by Mr. Curry. —Lost a cow in December, on a Sunday; missed her in the morning; had tied her in the bire the night before ; there was no door on the bire ; saw the hide afterwards ; saw it in Catherine Taylor’s; Taylor's is four miles from witness’s house; saw the hide the same day on which the cow was stolen; swears the hide he saw in was the hide of the cow he lost ; does not know who stole the cow; found two vessels of warm blood and two quarters of a cow in Taylor’s at the same time. Cross-examined by Mr. J.Quinn—Swears positively the hide he found was the hide of the cow he lost; got a large flaxseed barrel, “ filled with turkeys and all sorts of meat,” concealed in Taylor’s house. Ellen Taylor, examined by Mr. Curry—Lives near Balleek ; lives with her mother; remem bers a cow being brought to her mother’s on the Sunday might in question; Hanna came to her mother’s window, and said that he wanted her to go to a woman in travail; witness opened the door, and for a coal ; gave it to him ; witness afterwards went to the barn ; saw Hanna, Smyth and Maguire, there (identifies them) ; they had unloosed her mother’s cow from the bire, and were preparing to kill some strange cow ; they killed her ; took two quarters of the meat away by order of Thomas Whelan ; witness and Smith had previously gone for Whelan ; they left a side of the beef in mother’s ; does not know what they did with the hide or entrails; remembers the prosecutor Gallagher coming to her mother’s house ; witness was taken prisoner. Cross-examined by Mr by Mr. J. Quinn—The last place she lived in was the gaol ; swears she never was charged with stealing the cow; never left the country ; was on bail to attend at last Assizes ; does not know whether it was to take her trial, or give evidence against prisoners ; that she was on bail; attended the Assizes; did not hear her name called; swore against prisoners two months ago; the cow was brought to her mother’s in December; never swore a rape against any one; swears she never got money for not swearing against any person ; was not found concealing the hide; the prisoners were in the country ever since; heard they made their escape once; witness does not know what she was put in gaol for; remembers being in Captain Reed's office; did not tell about prisoners then ; said to Captain Reed she knew nothing about who brought the cow to her mother’s; witness is married; does not know where her husband is now; has no second husband here. Re-examined by Mr. Curry—The reason why she did not tell Captain Reed about the prisoners was, because she heard the prisoners had declared “they would have her life by night or by day, if she informed on them.” Thomas Whelan, examined by Mr. Curry— Knows prisoners (identities them ;) saw them in Widow Taylor's in December last, before Christ- mas; Smith came for witness ; saw Maguire and barn; there was a dead cow in it; understood it was to buy beef he was sent for ; was told so inthe barn ; bought a side of beef; Maguire and Hanna carried it to witness's house; paid Hanna 7s. on account for it; was to pay a penny a pound for the beef! Cross-examined by Mr. J. Quinn—Was sent for to buy beef; told Capt. Reed about Maguire ; witness was not concerned in stealing the beef; thinks the prisoners were; it was in the night time he went to the barn. By the Court—Informed Mr. Reed and Mr, White about the prisoners ; prosecuted old at last Assizes. Gallagher, the prosecutor, recalled—Found the heef in the kitchen; the hide in a hole three or four perches from the barr; the hole was filled with water. Cross-examined by Mr. J. Quinn—Knows the witness ‘Taylor's character; considers her unworthy of belief on her oath. By the Court—Knows Whelan ; understood that before he (witness) lost his cow, Whelan was a harbourer of stolen goods; thinks, from his character, he is unworthy of belief. W. Reed, Esq., examined by Mr. Curry—Is a Magistrate for the County ; knows Thomas Whelan; swears he considers him worthy of belief in a Court of Justice. Edward Hanna—Is_ father to the prisoner Hanna; remembers Catherine Taylor coming for his son on the 3d of last December; wanted him to kill a cow. Cross-examined by Mr. Curry —It was on Saturday morning Taylor came for his son ; (the said cow was stolen on Saturday night.) Patrick Fitzpatrick, examined by Mr. J. QUINN — Resides near the prisoner Hanna; he (Hanna) is in the habit of killing cattle for to oblige his neighbours. Mr. Curry— Does he often kill cattle after night? He might Mr. Curry — Aye, once on a Sunday morning, too !—Go down.’’ The Jury immediately returned a verdict of Guilty all the prisoners: 7 years’ transportation. Newry Telegraph, 24 July 1832.
