Per "Indian", 1810; prisoner in Van Diemen's Land 1817 Jun 26 Re doubt over length of his sentence (Reel 6005; 4/3496 pp.210-11) 1818 Dec 23 Re duration of his sentence (Reel 6006; 4/3499 pp.226-7) 1818 Dec 23 Re nature of previous correspondence (Reel 6006; 4/3499 p.228) ------------------------------------------------------------- Secretary’s Office, Sydney, 23 Dec 1818. Sir, In answer to your letter of the 10th inst, this day received, and in order to close all correspondence for the future in regard to your sentence of Transportation, I now transmit you a correct extract of your sentence from the Indents. Andrew Stewart, tried at Edinburgh Circuit Court of Justiciary in 1809 - sentence, Transportation for Life. John Macintyre tried at the same time, and place, and Thos. Howard, tried at Glasgow in 1808 had the same sentence of Transportation. These three persons in the Indents are circumflexed thus - John Macintyre } Andw. Stewart, } Thos. Howard } The Contractors to have their services for seven years from the 5th day of July 1810. As you have received a Conditional Certificate (as you term it) under date the 26th August 1817- whereby you are exempted from all service to the Government or restraint, save that of not being permitted to leave the Colony – a restraint necessarily implied in your sentence of Transportation for Life – You have no ground of reasonable complaint whatever, and your frequent troublesome applications and misrepresentation of facts will only tend to prove you undeserving of any relaxation of the existing restraint on you from this Govt. Altho’ I address this letter to you, I shall send it, under cover, open to His Honor Lieut. Governor Sorell and request him to read it previous to your receiving it. I am… (Signed) J. Campbell, Sec. C. of J. 13 Jan 1809, Life. -------------------------------------------------- Tasmanian Record: https://stors.tas.gov.au/CON13-1-1$init=CON13-1-1P74 Andrew Stewart: Came in the Indian (not the Guildford as represented to your Honor) under sentence “for Life,” with the following reservation in his favour “The Contractor to have his Services for seven years from the 5th day of July 1810.” It being doubtful how such sentence, (in one part expressing transportation for Life and in another limiting his Servitude to seven years) should be understood and acted upon here. His Excellency the Goveror has made a reference on this man’s and some similar Scotch cases to the Secretary of State, and an answer may be expected by the first oppportunity form England. In th emeantime, whatever rule may be hereafter adopted, the Applicnt, Andrew Stewart has not yet suffered any injury, as his seven years services to the Contractor will not expire until the 5th Proximo. As the humane construction of the Sentence appears to be that of renouncing any further claim to his services after the approaching 5th of July, the Governor is pleased to say that you may give Stewart a Conditional Certificate at that time, holding him under sentence of residence for Life within this Territory. Tasmanian Archive record show that Andrew was transferred to Van Diemen's Land (Tasmania) arriving 1/1/1811.

On 16 January 1809,the subject along with John M'Intyre, shoemaker and brother Robert Stewart, journeyman bookbinder, appeared Edinburgh High Court on libel - together during night Wednesday 1 November 1808,breaking into the shop of Peter More,calico glazier, Edinburgh and stealing 30 calico webs. All found guilty. Robert Stewart executed 22 February 1809 at Edinburgh Tolbooth. Subject Andrew Stewart along with John M'Intyre transported for life.
