City Sessions Court. William Sullivan, and Timothy Leary, for stealing pigs, the property Denis Mulcahy, on the December. Denis Mulcahy, sworn and examined by Mr. M'Carthy, (Solicitor) —Is farmer ; lives about 8 miles from Cork, near Watergrass-hill ; lost four pigs, and was shown them in a yard in Cockpit-Jane, by Sergeant Haly ; knew the pigs when he saw them, and has three others of the same litter. Cross-examined by Mr. Fitzgerald . —Did not find the pigs in Mrs. Buckle's house; was told there were pigs in Collins's-lane; went there, and saw a pig, but it was not his. Constable sworn and examined by Mr. Fitzgerald —Took Mulcahy to Cockpit-lane where we saw pigs, which Mulcahy identified ; the prisoners were present, and they said they bought the pigs at Cloyne fair, went there twice; the first time told Mulcahy to say the pigs were not his, in order to come by the arrest of the prisoners. Constable O'Hara sworn and examined —I know the prisoners; arrested them at house of Browne, in Cockpit-lane; I know Mulcahy I heard him say the pigs were his. Margaret Browne examined by Mr. M'Carthy—Lives Cockpit-lane; knows the prisoners, who boarded with her; about week ago they asked me I had a yard to my house; said, I had; and they asked me if they could bring in some pigs; I said they could ; they left me about 1 o'clock in the day, and did not return until about 8 o'clock in the evening following day Constable Haly and Mulcahy came to house, and Mulcahy said in my presence that the pigs were not his. Cross-examined by Mr. Fitzgerald —Keeps an eating house ; prisoners boarded with her; heard them say they dealt in cattle ; they never brought pigs to her before, the pigs were not fed in my place. Mary Sullivan sworn, and examined by Mr. M'Carthy —Lives in Collins's-lane; knows Sullivan to be a dealer in pigs, they brought into her house, on Tuesday the 7th December, four pigs and asked to leave them there for few hours; allowed them; the pigs remained there until 8 o'clock in the evening; was told Leary that he bought them at Cloyne Fair; did not tell why he took the pigs away. Cross-examined by Mr. Fitzgerald —does not know Leary, but often saw him at the Cattle-market; Learv brought pigs to her before present time; it is not uncommon thing for pigs to brought in early in the morning, for sale the course of the day; can swear that the pigs that were in the yard were those that were after found; told Sergeant Haly that that I could not swear to the pigs; but that my sister could. Verdict Guilty, sentence deferred. Cork Examiner 20 Dec 1841.
