James Topp was transported on the Surrey Or Surry, departing 31st Dec 1813 and arriving 28th Jul 1814 with 204 passengers.

Built at Harwich in 1811 a square-rigged transport ship of 443 tons and copper lined she had two decks with a height between decks of 5 ft. 8 ins. In 1818, she had a major refit increasing the decks (and convict carrying capacity) to three. She was owned by the London firm of F. & C.F. Mangles.

COURT OF CRIMINAL JURISDICTION. THURSDAY, DEC. 10. James Topp was found guilty of sheep stealing, and remanded for sentence. Sydney Gazette, 19 Dec 1818. Criminal Court. Wednesday  … and, James Topp, a fugitive from Newcastle, convicted of a most direful assault with intent to rob and murder. …. James Topp (who had been before a fugitive from Newcastle, whither he had been sent from hence for a serious offence, and who had now been convicted of sheep-stealing) was next addressed, and his former offences alluded lo by the learned Judge ; who, in the hope of his amendment, and of his proving himself as well as those by the side of whom he was placed, not unworthy of the clemency to which he was now indebted, felt happiness in recording the sentence which saved his life The judgment of the Court was, that with the exception of Topp, they should he all transported for life to Newcastle ; and that he should be transported for life also ; to such place as His Excellency the GOVERNOR should think proper to order. The Assizes for this county finished on Tuesday evening :- seven prisoners were capitally convicted, and received sentences of Death, viz.- Thomas Plank and James Topp, for stealing plate from the dwelling-house of Betty Young, of Marden; …. Plank and Topp are left for execution, the others reprieved before the judges left the city. Salisbury Journal, 9 Aug 1813 Respites have been received for Thomas Plank and James Topp, the two men left for execution at our late Assizes.
