Peter Vallack, who surrendered on his bail, pleaded guilty to having on January, 1860, feloniously and unlawfully married one Annie Brown, his wife Catharine (maiden name Nolan, whom he married on 8th February, 1858). being still alive. Mr. Adye Douglas addressed his Honor in mitigation prisoner's offence, and handed in an affidavit diagnosing the facts of the ease, together with a memorial In prisoner’s favour from Annie Brown. The affidavit set forth the circumstances of the case, and disclosed the prisoner, who was a widower, married Catherine Nolan, a spinster, in 1858. She lived with him seven days and then took her departure from him. He went after her and induced her In return, she only resided with him for three weeks in all and he did not see her again until September. During this period she cohabited with a man named Parick M'larvey Alter her departure prisoner became acquainted with Annie Brown, who at that time kept a school at Westbury. She resided at his place for some time, and took care of ani instructed his children, and in January, 1860, he married her. It appeared that during this time his real wife Catherine, had several illegitimate children by Patrik M'Lavey and even registered one of them at Westbury. These facts were also disclosed in the examination at the Police Office. There were some extenuating circumstances in this case ; the prisoner though respectable was very ignorant, and contracted the second marriage under the assumption that he was justified in so doing, as his wife, Catherine, had tell him to live with another man; it also appeared from the memorial that Annie Brown was aware of all the circumstances, so that there was no concealment. The prosecution was instigated by the first. wife in order either to give annoyance or to see If she could not extort some money for withdrawing the charge. Under all these circumstances he (Mr. Doulans) trusted his Honor would take the case into his favourable consideration and pass as lenient a sentence as possible.
