David sounds as if he became mentally ill as he aged. The Ballarat Star reports on 30/ 06/1870 he was brought before the court for bestiality. On 14/02/1871 he was brought before the court for being drunk and being drunk in charge of a horse and cart. There is a possibility that his brother William had David move to King Island to mind sheep and protect from further incarceration. This is substantiated by his Vallance nieces travelling to the island to visit, William's ownership of a sloop which sank close to Launceston and William's run in with port authorities and fining by a local magistrate of 1s for not branding sheep correctly. There is reported to be an entry in a lighthouse register of David having being found dead in a humpy on the Island. A very sad end for David but the foundation of the Old Cumnock Vallance family which followed David to Australia.

David Vallance was transported for stealing 8 sheep. David was 23 years old, 5'7 1/2" tall, could read and write, fresh complexion, brown hair, dark brown bushy beard, blue eyes, black eyebrows, mole on back of neck, scars on 3rd and 4th finger of left hand. David was married with 1 child, wife was Euphemia. His father was Robert, in all there were 12 children. Period of Probation: 15 months. 19/2/1845: Released from 1st stage of Probation 3/8/1847: TOL 10/8/1847: TOL Revoked. 24/3/1848: TOL 7/5/1850: Free Certificate. 8/4/1852: Steerage passenger Launceston-Melbourne per City of Melbourne, Free by servitude. 7/6/1852: Steerage passenger Launceston-Melbourne per Waratah, Free. William, his brother, B1832 died 1924 married Mary Ferguson in Bute on 18/6/1852 and they came to Victoria in 1864/5. They had 11 children. 29/3/1853: The Argus, Melbourne: NOTICE: If this meets the eye of James Kerr or David Vallance from Cumnock, Ayrshire, they will find their brother William by addressing, care of John Batie, Cowie's Creek, Geelong. This was advertised until July 1853. 4/4/1864: The Star, Ballarat - David Vallance on trial for stealing a sheep at Sulky Gully, on the Creswick road. There was not enough evidence and he was discharged. While at Sulky Gully, David was a gardner. Could find no date of death.
