Does the following report refer to Catherine?? CENTRAL CRIMINAL COURT. FRIDAY. BBFORE his Honor Mr. Justice DICKINSON. BIGAMY. Catherine Bermingham was indicted for that she on the 12th October, 1840, married one Patrick Bermingham, bachelor ; and that being so married, she on the 17th day of April, 1849, feloniously married one James Woore. The prisoner was undefended. The ATTORNEY-GENERAL stated the case, and called John Toole, who deposed, that in 1840 he resided at St. Mary's Church, and knew the Rev. Francis Murphy, who officiated as a clergyman at St. Mary's in 1840 ; remembered seeing the prisoner and Patrick Bermingham being married by the Rev. Dr. Murphy ; the prisoner's maiden name was Catherine Foren ; saw the parties sign their names to the marriage ceremony, and witness signed it too. Cross-examined : Could not swear that the prisoner was the person who was married to Patrick Bermingham in 1840. By a Juror-Should not have recognized the prisoner as one of the congregation at St. Mary's ; did not remember to have seen her before or after the marriage. Constable Carroll had known the prisoner since 1836 ; she went by the name of Catherine Bermingham. Another man of the name of Welsh claimed her as his wife; she always lived with Bermingham as his wife ; she once showed witness a paper, and stated she was married to Bermingham ; saw Bermingham at the Police Office, but did not know if he was dead since. She lived with, Bermingham up to about four years ago ; had not seen Welsh since 1840. The Rev. Mr. Priddle deposed that on the 17th April, 1849, he married one Catherine Attridge to James Woore. The marriage was entered in the Registry, but witness did not personally recollect either of the parties. The Registry was signed by two witnesses. The witnesses to the marriage identified the prisoner. James Woore deposed that he was married to the defendant, and was courting her for five or six weeks before ; lived with her about five weeks. She said she had lived with Bermingham, but was never married to him, and that her maiden name was Attridge. Witness heard that she was married to Bermingham, and charged her with it, when she struck him, and afterwards owned she was married to Bermingham. Bore the witness no ill-will, but wished to be rid of her. The prisoner, in defence, denied having ever been married to Bermingham, and called Mr. Robert Johnson, who stated that he had drawn up a document signed by the prisoner and Patrick Bermingham, to the effect that they were never legally married, Bermingham stated at the time that the marriage ceremony had been performed between them; but that the prisoner was then married to a man named Welsh. The prisoner denied that she was married to Welsh at the time she married Bermingham. His HONOR summed up. The Jury retired for about half an hour, and returned with a verdict of guilty. His HONOR passed sentence, commenting on the graveness of the offence, and its injurious effects on society. Imprisonment in Sydney Gaol for twenty-two calendar months, the prisoner having been already six weeks in prison. Sydney Morning Herald, 3 Nov 1849.
