Convict Notes
Thomas Hickmott, 42, for rescuing from the custody of William Crowhurst, the body of Samuel Walters, the said Samuel Walters being charged with and suspected of felony, at Ashurst. It appeared that warrant had been issued Mr. Akers, a magistrate, on the 17th Dec., against person named Walters, on a charge of felony at Ashurst. The constable directed a man named Malcomber to make the arrest, who in his turn, authorised William Crowhurst to apprehend Walters, who was found by him at a public-house, and taken into custody. The prisoner seized Crowhurst by the neck, and, assisted by several other persons, succeeded in rescuing Walters, who made his escape. Mr. Perry who was counsel for the prisoner, contended that the arrest was illegal, Crowhurst, not being a constable, was not justified in detaining Walters; there being no evidence to shew that the prisoner knew of the charge against him. Two months hard labor. South Eastern Gazette, 12 Jan 1836. Sussex Adjourned Sessions. Samuel Walters, brickmaker. charged with stealing on or about the 29th November last, one thousand nine hundred and forty four holly slicks, the property of the Earl la Warr. Guilty seven years' transportation. Sussex Advertiser, 29 Feb 1836.
