His original sentence was for stealing items - see https://www.oldbaileyonline.org/record/t17850223-104

Thomas Ward was first sentenced to transportation but received a conditional pardon while in a hulk at Portsmouth. (The condition being to leave the country.) He was apprehended in St Giles, London, tried for returning from transportation and got death sentence (respited to 7 years transportation).
