John Warne, convicted of felony at the last Hants Assizes and sentenced to be transported for life, (and who was tried at Winchester about 2 years since for sheep stealing,) has hit on a scheme, which has already, on his part, had some good effect ; as it appears he has not been sent on board the hulks with the other prisoners from Winchester who were convicted at the same assizes. In order to have his sentence lowered, he revealed the names of several of his companions, with their crimes, (or promised to do so,) with the hope that his sentence would be commuted to seven years transportation, and it had so far succeeded, as to get the committing magistrate, H.W. Powell, esq. to write to the Secretary, or under Secretary of State for the Home Department, on his behalf. It is however discovered that he has deceived the worthy magistrate and other measures have consequently been resorted to. Court and date of trial: Hampshire Lent Assizes held at Winchester 1830. Crime: Cattle stealing, namely a calf, the property of James Ball of Burley, Hampshire, butcher. Initial sentence: Death, commuted to transportation for life. Annotated (Outcome): Nil. Petitioner(s): Prisoner; Love Warne of Hurn near Ringwood, the prisoner's aunt. Grounds for clemency (Petition Details): The prisoner is innocent; he had no time to prepare his defence before trial; the prosecutor's evidence was inconclusive. Grounds for clemency (Petition Details): Disputes the evidence given at trial, the calf found on Warne's premises was one he had purchased. With sworn statements. The prisoner is a notorious bad character suspected of carrying on sheep stealing for a number of years. Letter from G H Rose on behalf of the vestry of Ringwood asking to see names on the petition in favour of Warne. Calls Warne a notorious thief and comments on his aunt going in the forest at night 'at the top of her speed, dressed as a man with kegs of gin on her cantle'.
