Convict Notes
On 7/10/1829 Lewis Wellard was convicted of stealing a lamb in the Folkstone Court in Kent, England, only 3 years after his father William was transported to NSW for horse theft. Lewis was subsequently sentenced to death but on appeal the death sentence was commuted to transportation to NSW Australia for fourteen years. 228 convicts embarked for the 134 day voyage which sailed from Sheerness on the 19/4/1830, of which 227 arrived at Port Jackson on the 21/8/1830. Lewis was described as “being 30 years of age, 5 feet 4 inches tall, of ruddy fair and freckled complexion with brown eyes & black to grey hair”. Lewis left his wife Mary to fend for herself with a young son, Lewis junior. On arrival Lewis was assigned to Lieut. Mitchell, R.N. of Sydney. Lewis was granted his ticket of leave on 4/10/1836, six years after his arrival and permitted to remain in the Port Macquarie area. Lewis never returned to England and stayed on in Australia deserting his English wife Mary, remarrying and settling in NSW. In 1837 Lewis was working as a labourer for Major Archibald Innes at Port Macquarie. Innes had land at Port Macquarie, Walcha & Northern Tablelands, Mid North Coast and Darling Downs, QLD. In 1862 Lewis Wellard received permission to marry Mary (Burrows) Powell, also a convict and subsequently had four other children with her. He also had two step children from Mary (Burrows) Powell's previous marriage Frances Powell. Lewis' date of death is not known but it is known that he disappeared. Lewis' wife Mary, who tended to like a little drink, was arrested by the police for being “Drunk & Disorderly” on a number of occasions. Police records for a arrest on 13/12/1866 sates that Mary was 53 years of age and married, then when arrested on 30/10/1868 the records state that she was a widow. So is can be assumed that Lewis must have died around 1867. On 3/8/1865 in Orandumbie, Walcha, NSW the remains of an unknown male were found. On 15/8/1865 CW Adams MD Coroner at the Walcha Court House, determined the possible cause of death of the unknown male was "Delirium Tremens" (Delirium Tremens is a medical term that refers to severe symptoms alcoholics can experience during withdrawal such as tremors, confusion, and hallucinations) the "remains of the body destroyed by birds" The Coroner found that the remains could possibly be that of Lewis Wellard but true identification of the remains could not be determined.
Lewis could not have died 1862 as he gave consent to his daughters marriage in 1865, according to my Grandfather he claimed that Lewis disappeared a few years after that, no death record has been found for him in Australia.
17/4/1829: Lewis married Mary Ann Nuttall in Kent, England. Mary Ann Burrowes B:182 Cork, Ireland -married Charles Powell, on 2/7/1836 at St Thomas C of E, Port Macquarie, NSW - (Charles Powell was born in 1801 in Canterbury, Kent England and died about 1856.) The had 5 children. Charles Powell died ???? but Mary Ann was living with Lewis Wellard by 1844 when they had their first child, William Wellard 2/4/1844 born at Maidland NSW. 1848 Stephen Wellard 1848 Elizabeth Wellard. Lewis Wellard married Mary Ann Powell 20/9/1862 after Charles Powell died. 30/9/1862: Date of death of Lewis Wellard - from a family website - nothing recorded on the NSW BDM - (Age 57) Walcha, New South Wales, Australia. Son: Stephen Wellard Born: 1848, Port Macquarie, NSW Australia Died: 25 Jul 1933, Walcha, NSW Australia at age 85. Grandson: Australian Stockman's Hall of Fame and Outback Heritage Centre. Louis Hugh WELLARD, b. 18th December 1881, Tamworth NSW, d. 3rd April 1963, Walcha NSW.
Lewis was convicted during the October 1829 sessions of stealing a lamb and was sentenced to Death! This was commuted to 14 years transportation to Australia. He was held on the prison hulk Retribution at Woolwich, where his gaolers described him as "idle and disorderly".
