Cork Assizes. CHARGE OF ROBBERY. William M‘Carthy was indicted for assaulting Cornelius Collins, and forcibly taking from him 8£. 6s. on the ? April. Cornelius Collins—ls a pensioner; was returning, in April II o'clock night, from Ballincollig, where he got his pension money; four men met him near South-gate-bridge; on his passing them, two of them seized him by the arms, and the others his pockets ; they then threw him on his face to the ground, and ran away; identifies the prisoner as one of the men who attacked him. Mr. J. P. Matthis— It was he took the last witness to the Bridewell, where had all the prisoners in one room, and Collins at once identified the prisoner, who was committed on the 2lst There was no defence. His Lordship charged the Jury, one of whom, after half an hour's deliberation, begged ask his Lordship if to constitute robbery, the man robbed must be put in terror of his life? His Lordship then again read to the Gentlemen the law of the case;— is enough the fact attended with such circumstances of terror, such threatening word or gesture, as are likely to raise an apprehension, and induce a man to part with his property for the safety of his person, and it is not necessary that fear should be strictly proved. The Jury then again retired, and shortly after returned a verdict of Guilty. Cork Constitution, 29 Aug 1833.
