From: The Perth Gazette and West Australian Times, Fri 3 Apr 1868, p2: "SUPREME COURT. (Before His Honor the Chief Justice.) Wednesday 1st April, 1868. John Cullen, charged with obtaining at Bunbury, sundry articles from James Oldham under false pretences. James Oldham deposed—That on the 19th February last, Thomas and John Kelly left in his charge to take into Bunbury, three pair of trousers, &c.; he took them in on the 6th, to the house of Thomas Jones, and in the afternoon prisoner came the and told witness that Thomas Kelly had sent him for the clothing, &c, left in his charge; they were in a bag, and witness gave them to him, believing his statement, and because he had often seen him and Kelly together. Kelly had not told him to deliver them to the prisoner. Thomas Kelly deposed—That he and his brother John left their clothing in the charge of the last witness to take into Bunbury, and on the 27th was informed by him that he had delivered the things to Cullen. Had never given Cullen any authority to ask Oldham for the things; he was with witness when he asked Oldham to bring the clothes into Bunbury. John Kelly, brother of last witness gave similar testimony. The prisoner's statement before the Magistrates was put in and read, it stated that Kelly, when in a state of liquor, had told him to obtain the goods, that he had done so, and afterwards laid down in the street with them, under his head, and did not see them afterwards.
