John was charged at Lent Session of Surrey Assizes with "larceny on a navigable river" ie. stealing merchandise from John Fox in a vessel on the Thames, in company with John Lawrence. On 29 March 1813 he was sentenced to be hanged, the sentence later being reprieved to transportation for life. He was described as "John Fannance late of Parish of St Olave, Southwark, Surrey, labourer" and in another place as "alias John Fannance, waterman of London, age 23, 5'4" tall, dark/sallow complexion, black hair, hazel eyes". He was transported aboard the ship "General Hewitt" and arrived Sydney 7 February 1814. His wife, Mary and infant son Joseph arrived together on "Broxbornebury" 28 July 1814. John Anthony was assigned to the service of John Suddis and taken to the Hawkesbury area, where he was joined by wife and child. Four years later he was granted Ticket of Leave No. 1400 and the following year was employing his own servant when he sought work at Castle Hill. He obtained a Conditional Pardon in 1824 when he and his family lived on the Lower Branch of the MacDonald River.
