FOOTNOTE re his age: John Newton was listed on the Portland jail register and WA Convict register as 32 years old when convicted in 1855 (Western Australia, Australia, Convict Records, 1846-1930; Convict Department, Registers; Convicts Transported Per Nile (R32)). However, on the Nile's manifest he was listed as aged 52 when convicted (Western Australia, Australia, Convict Records, 1846-1930; Convict Department; Estimates and Convict Lists (128/1 - 32)). A third record, from Fremantle jail (above), gives his year of birth as 1806.

Newspaper reports of his trial: "John Newton was found guilty of an unnatural offence at Brandon and sentence of death recorded against him." (Bury and Norwich Post, 8 August 1855, p5) "UNNATURAL OFFENCE. John Newton, 35, labourer, was found guilty of an unnatural offence at Brandon. Mr. Marriott was counsel for the prosecution. Sentence of death was recorded against the prisoner, the Learned Judge remarking that it would be his duty to recommend that the life of the prisoner be spared."
