Jacob was tried and sentenced to 7 years transportation at Warwick Assizes, 26th March 1787, although the actual indictment cannot be traced as the assizes records for Warwickshire were accidentally destroyed last century. However, his trial received a mention in the Birmingham Gazette on 2nd April, 1787, and in a list of the Enrolments of Certificated of Convictions of Felons for the years 1773-1822 at Warwickshire County Archives. From the Birmingham Gazette: "The Commission for holding the Assize for this County was opened on Monday last at Warwick, before Mr Justice Heath. Sixty Prisoners took their trials at the Bar, four being capitally convicted and received the sentence of death, (Jacob Russell was one of the four) for the burglary in the house of William Ordridge in this town. Commuted." From the List of Enrolments and Convictions of Felons: "The prisoner Jacon Russell was convicted of burglary in the dwelling house of William Ordage ? on the night of the 20th November at Birmingham. He was convicted of felony and burglary pursuant to the Act of Parliament." Jacob spent the next four years in jails and on hulks before boarding the Third Fleet ship "Salamander" among 160 male prisoners and sailing from Plymouth on 27th March 1791. Jacob, on arrival, August 21st, 1791, was assigned to the Superintendent of Convicts at Parramatta. He worked on the preparation of ground and cultivation of crops. Three years later, 22nd March 1794. he was granted his freedom to remain in that district. 1794: 19th November, Jacob received Land Grant No. 265, a thirty acre block on the South Creek of the River Hawkesbury in the District of Mulgrave Place (Windsor). Lieut Govenor Francis Grose settled 40 emancipists there during that year. The rent was 1 shilling per year commencing after 10 years. James Ruse who farmed that one and a half acres received the first land grant in NSW in 1791, was Jacob's neighbour. 1799: 18th December, Governor Hunter issued Grant No. 915 of 30 acres to Jacob, this grant was also at South Creek, Mulgrave Place. Quote: "This allotment contains 25 acres purchased by Jacob Russell from Richard Podmore, a private in the NSW Corps and 5 acres of high land granted to him to build on."
