James was indicted for stealing 20 bushels of wheat from his 'master' William James Reynolds at the Old Bailey on 1 Nov 1848. The jury found him guilty and he was sentenced to be transported for 7 years. He applied for permission to marry Honor Tremelling and this was granted by the authorities on 29 Jun 1852, despite the fact that Martha was still alive. He was granted a conditional pardon on 31 May 1853.
