The 1831 marriage to Mary Scott was bigamous as her husband was also in the colony. Fr John Therry disobeyed a colonial decision and went ahead and married them, perhaps because he was lied to, e.g. Mary Scott was incorrectly listed in the marriage register as the widow of Thomas Stubbs of the 57th regiment.

John's surname was actually Devenish, he received his freedom in March 1831 and married another Irish convict Mary Scott in May 1831 at St Mary's Cathedral in Sydney.
