He joined the 33rd Company of the Plymouth Division of the Marine Corps at Birmingham on 16 April 1781. He sailed on 'HMS Lively' to New York and then to the West Indies. His ship was taken over by American rebel prisoners, who had been held captive on board. He was taken as a prisoner to Havana where he remained until after the War of Independence May 1783. When peace was signed in 1783 John and other English prisoners were exchanged for Spanish prisoners and he eventually got back to Port Plymouth in August 1783. Along with Stephen Davenport, John Herbert and Robert Ellwood, John then became a highwayman. John was tried at the Devon Lent Assizes held at Exeter Castle on Monday 14th March 1785, with Stephen Davenport, John Herbert and Robert Ellwood for feloniously assaulting James Burt in the King's Highway, feloniously putting him in corporal fear and danger of his life...and feloniously and violently taking from his person and against his will in the said highway, one metal watch and tortoiseshell case value 30shillings one pruning knife value 6 pence and five shillings his goods." They were found guilty and sentenced to be hanged. Royal mercy extended on Herbert and Small to transportation for seven years, John spent time on the prison hulk 'Dunkirk', where he was reported to be "troublesome at times". Left England on 13th May 1787. Ship:- the 'Charlotte' sailed with 88 male and 20 female convicts on board of which 4 males died during the voyage. Arrived on 26th January 1788. He was apparently working at the hospital as is indicated by John Cobley in his report dated 3rd July 1788 when John was accused of drunkeness - a charge which was later dismissed for lack of evidence. The next time John Small came to notice was when he and convict Mary Parker were married by banns by Richard Johnson,Chaplain on the 12th October 1788 with Samuel Barnes and Thomas Akers as witnesses. The newly married couple lived in a hut at Parramatta before John received his Land Grant at Eastern Farms in 1794. John had 30 acres of land, all cleared, 20 acres of which was cultivated. John and Mary had 7 children Between 1789-1804, all of whom attained maturity, quite a feat in those times. He was a Protestant. He was Freed by Servitude and appointed a constable from the beginning of 1809 and this appears that this position was of District Constable as he gave evidence at the inquest into the death of George Patfield later that year. Mary died suddenly and tragically on 4th April 1824. An inquest commencing on the next day, the 5th, shows the circumstances as follows: Mary was walking near a large hole of seven feet depth of water, close to which is a footpath. Mary missed her footing and fell into the water of the foresaid large hole, and then drowning, she instantly died. Her son John attested that about 6 o'clock in the evening he was at his brother William's house, when his wife asked him to fetch a pail of water. John and William walked to the well, which was a large hole 7 feet deep. As they approached the well they could see two shoes and a woman's cap floating on the surface. William stooped and got out one of the shoes and said that he feared it was his mother's. John stayed at the well whilst William ran to the house and found that his mother had been from home for some time. Whilst his brother was gone John got a pole and raised a female to the surface, and found it to be his mother. Efforts to revive her were without effect. She was dead at the age of 66 years. Mary had last been seen at about 2 o'clock by her son Samuel who lived with her. When the coroner asked what state Mary had been in lately her son said that at times she appeared childish, but had supposed it to be infirmity of old age.
